Unverified Reviews Policy

By accessing the platform: https://proviews.com/ (hereinafter referred to as “Website”,“Platform” and/or “Application”, which shall mean and be used interchangeably having thesame meaning) is developed, operated and maintained by Simprosys InfoMedia (hereinafter referred to as “the Company”), a company having its registered office at B-303, Shapath Hexa, Opp. Gujarat High Court, S.G. Highway, Ahmedabad, Gujarat – 380060 India, you agree to be legally bound by the following content policy and other incidental or related aspects for use.

This Unverified Reviews Policy (“Policy”) is framed and published by Simprosys InfoMedia, operating under the brand name Proviews (“Company”), in accordance with the provisions of the Consumer Protection Act, 2019, the Information Technology Act, 2000(including all applicable rules thereunder), and the Guidelines for Prevention of Misleading Advertisements and Endorsements for Misleading Advertisements, 2022, issued by the Central Consumer Protection Authority (CCPA). This Policy seeks to uphold the principles of

transparency, accountability, and consumer trust in respect of user-generated content, specifically customer reviews collected, managed, and published through the Proviews Platform.

Before you use the platform, you must read all of the terms and conditions of this policy (“Terms”) herein provided on the Website. Please also refer to the additional legal information as may be applicable to you. You must be at least [18] years of age to use our platform/website; by using our platform and agreeing to the contents of this policy, you warrant and represent to us that you are at least [18] years of age. Audience less than 18 years of age should register with credentials of Parent(s) and/or Legal Guardian. The platform shall not be responsible for validating and authenticating your age, however, platform reserves the right to optionally / randomly conduct checks to verify the correctness of legal age of your’ s / your legal guardian’s age registering on platform on your behalf. “we”, “our” and “us” means “the Company”; “you”, “user” and “your” means any person and/or the institutions / organizations etc., but not limited to, who accesses and uses this Platform along with updating their users on this platform.

It is strongly recommended to you to visit this page periodically to review the most recent and current version of this policy. The Company reserves the right at any point of time, at its sole discretion, to change or otherwise modify the terms of this policy without prior notification or notice to you, and your continued access or use of this platform signifies your acceptance of the updated or modified terms. If you object to this policy or any subsequent modifications to this policy or become dissatisfied with the platform in any way, you should immediately terminate the use of this platform. Should parts of this information not or no longer comply with applicable law, the remaining parts of the information remain unaffected in terms of its content and validity.

GENERAL TERMS

This Unverified Reviews Policy constitutes an electronic record within the meaning of the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023, and is published in compliance with Rule 3 of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. This document does not require any physical or digital signature and is generated by a computer system. It shall be deemed to have been accepted by the User upon their access to or use of the Platform. By submitting, managing, displaying, or otherwise interacting with customer reviews through the Proviews platform and its associated tools, integrations, or services (collectively referred to as the “Services”), you expressly acknowledge that you have read, understood, and agreed to be bound by the terms and conditions set forth in this Unverified Reviews Policy, as well as any other applicable policies made available on the Platform, including but not limited to the Terms of Service and the Privacy Policy (collectively referred to as the “Agreement”).

If you do not agree to the terms of this Policy, or any future amendments or modifications thereto, you are advised not to submit, display, or rely upon Unverified Reviews and to discontinue any use of the Services to that effect.

PURPOSE AND SCOPE

This Policy governs the collection, handling, classification, display, and moderation of Unverified Reviews submitted through or displayed on the Proviews platform by merchants operating within the Republic of India.

An "Unverified Review" is any review, rating, testimonial, or feedback submitted by an individual claiming to have purchased or used a product or service, where Proviews cannot substantiate that purchase through objective, technical, or transactional evidence obtained from integrated merchant platforms such as order data, transaction confirmations, or fulfilment records.

REVIEW VERIFICATION MECHANISM

Proviews provides a verification mechanism that enables merchants to associate customer reviews with transaction data from integrated third-party platforms. A review qualifies as Verified only when:

1. The reviewer placed an order for the reviewed product using identifiable credentials such as an email address, phone number, or Order ID; and
2. That order data can be programmatically matched to the submitted review using tools provided by the Company.

Any review that does not meet both conditions above is classified as Unverified within the Proviews system.

Google Product Ratings Feed - Review Inclusion Policy
In compliance with Google's Product Ratings Policies, Proviews includes all review statuses in the product feed XML submitted to Google Merchant Centre, including Published, Unpublished, Pending (awaiting moderation), and Blacklisted reviews. This ensures complete data transparency as required by Google's submission standards.

Only reviews collected directly through Proviews are included in the feed. Reviews sourced via CSV imports, API connections, third-party app integrations, or any external channels are excluded to comply with Google's data authenticity requirements.

• Unpublished reviews
• Pending reviews (awaiting moderation)
• Blacklisted reviews

Excluded from Google Feed XML

• CSV / web-imported reviews
• API-connected reviews
• Third-party app reviews
• Any externally sourced reviews

Why are all review statuses reported to Google? Google requires merchants to submit their complete review dataset, not just “Published” reviews. Reporting “Pending” and “Blacklisted” reviews ensures full compliance with Google's data submission requirements and maintains eligibility in the Product Ratings program.

TREATMENT AND DISPLAY OF UNVERIFIED REVIEWS

Proviews gives merchants the technological capability to display or suppress Unverified Reviews at their discretion, subject to the following conditions:

1. All Verified Reviews display a non-removable "Verified" badge alongside the review text. Reviews without this badge are treated as Unverified by default; no explicit "Unverified" label is displayed.
2. Merchants must not modify or add a "Verified" status or any associated disclosure in any manner that could mislead end-users about the nature of the content.

MODERATION, REMOVAL, AND LIABILITY

The Company reserves the right, at its sole discretion, to remove, redact, or restrict access to any Unverified Review that:

• Is false, misleading, or defamatory
• Violates applicable laws or regulations, including the Information Technology Act, 2000, consumer protection laws, or intellectual property rights;
• Is generated through automated means such as bots or spam activity; or
• Breaches the Company's Content Guidelines or Acceptable Use Policy.

Google Product Ratings Moderation Compliance

• In accordance with Google's Product Ratings Policies, Proviews reports all review statuses, including reviews that do not meet moderation standards, to Google's product feed. This includes reviews flagged as inappropriate, spam, or blacklisted. Reporting these reviews to Google is a mandatory compliance requirement, not a reflection of the Company's endorsement of their content.
• Merchants acknowledge that while Proviews moderates review content on the storefront, Google's feed receives the complete review dataset as required. Merchants retain full control over which reviews appear on their storefront through Proviews' moderation tools, independent of what is reported in the Google feed.

Merchants bear sole responsibility for determining whether to display, rely upon, or engage with any Unverified Reviews. The Company disclaims all liability for consequences arising from the display or use of such reviews, including reputational, commercial, or legal implications.

Where an Unverified Review is suspected to be fraudulent or to impersonate another individual, the Company may suspend or terminate the associated account and, where legally required, refer the matter to relevant law enforcement authorities.

AMENDMENT AND REVISION

The Company reserves the unconditional right to amend, revise, or update this Policy at any time, with or without prior notice, to reflect changes in applicable laws and regulations, technological developments, evolving industry standards, or modifications to the Company’s internal policies, practices, or business operations. Such amendments may include, but are not limited to, changes in processes, user responsibilities, rights and obligations, or enforcement mechanisms under this Policy. Any revisions to this Policy shall become effective immediately upon their publication on the official website of the Company or through any other medium as may be determined appropriate by the Company. It is the responsibility of users, merchants, and other stakeholders to review this Policy periodically to stay informed of any changes. Continued access to or use of the Company’s services after the effective date of such revisions shall be deemed to constitute acknowledgement and acceptance of the modified Policy. In cases where material changes are made that significantly affect users' rights or obligations, the Company may, but is not obligated to, provide additional notice through email or platform notifications. However, failure to receive such notice shall not affect the enforceability of any such amendments.

CROSS-BORDER DATA TRANSFERS

In the course of collecting, processing, verifying, or displaying Unverified Reviews, certain personal data of users (such as contact information or transactional identifiers) may be stored, processed, or transferred to servers, cloud-based infrastructure, or third-party service providers located outside the territory of the Republic of India. Such transfers are conducted strictly for the purposes of providing the Services, enhancing platform functionality, ensuring data redundancy and security, or integrating with merchant systems and service providers. The Company undertakes to implement appropriate contractual, technical, and organizational safeguards to ensure that transferred data is subject to an adequate level of protection consistent with internationally accepted standards of data security and privacy. By using the Platform and submitting Unverified Reviews or associated data, you expressly consent to such international transfers of your data. You acknowledge that jurisdictions outside India may have different levels of data protection, and you agree that the Company shall not be held liable for any act or omission of foreign recipients, provided that the Company has exercised reasonable care and due diligence in engaging such recipients. If you are a user or merchant operating in a jurisdiction that restricts cross-border data transfers or requires specific authorizations, you are responsible for ensuring compliance with such laws before using the Platform. The Company disclaims any liability arising from failure to comply with such local requirements.

GOVERNING LAW AND JURISDICTION

The Company controls and operates this Platform from its headquarters in Ahmedabad (Gujarat), India and makes no representation that the Services offered on the Platform are appropriate or available for use in other locations or jurisdictions. If you use this Platform from other locations/jurisdictions, you are responsible for compliance with applicable local laws (including the taxation aspect, Fiscal and Economic Laws) and regulations including but not limited to the export and import regulations of other countries. Unless otherwise explicitly stated, all marketing or promotional materials found on this Platform are solely directed to individuals, companies, or other entities interested in getting onboarded onto the platform for the services as may be enlisted therein from time to time. By agreeing to these terms and conditions of use, you confirm and undertake that neither you nor any of your representatives shall have the right to challenge the governing law and jurisdiction as more specifically set out herein.
