This Authenticity Policy (“Policy”) is promulgated pursuant to and in alignment with the provisions of the Information Technology Act, 2000, including the rules framed thereunder such as the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021; the Digital Personal Data Protection Act, 2023; the Consumer Protection Act, 2019; and the Guidelines for Prevention of Misleading Advertisements and Endorsements for Misleading Advertisements, 2022, as issued by the Central Consumer Protection Authority. This Policy forms an integral and binding part of the overarching terms and conditions governing access to and usage of the digital platform ‘Proviews’, operated by Simprosys Infomedia (“Company”), and is intended to preserve and reinforce the integrity, reliability, transparency, and credibility of all user-generated content published, displayed, or accessed via the said platform, including without limitation reviews, testimonials, endorsements, feedback, and ratings.

Before you use the platform, you must read all of the terms and conditions of this policy (“Terms”) herein provided on the Website. Please also refer to the additional legal information as may be applicable to you. You must be at least [18] years of age to use our platform/website; by using our platform and agreeing to the contents of this policy, you warrant and represent to us that you are at least [18] years of age. Audience less than 18 years of age should register with credentials of Parent(s) and/or Legal Guardian. The platform shall not be responsible for validating and authenticating your age, however, platform reserves the right to optionally / randomly conduct checks to verify the correctness of legal age of your’ s / your legal guardian’s age registering on platform on your behalf.

“we”, “our” and “us” means “the Company”; “you”, “user” and “your” means any person and/or the institutions / organizations etc., but not limited to, who accesses and uses this Platform along with updating their users on this platform.

The Company reserves the right at any point of time, at its sole discretion, to change or otherwise modify the terms of this policy without prior notification or notice to you, and your continued access or use of this platform signifies your acceptance of the updated or modified terms. OBJECTIVE

The principal object of this Policy is to establish a robust governance framework for ensuring the publication, circulation, and reliance on content that is demonstrably authentic, experience-based, and free from manipulation or distortion. The Policy is aimed at nurturing an ecosystem of trust and accountability for all stakeholders of the Proviews platform, including merchants, consumers, users, and third-party content contributors. It seeks to deter the dissemination of false, misleading, or contrived content which may compromise the integrity of the feedback mechanism, influence purchasing decisions unfairly, or otherwise result in consumer detriment or reputational harm to legitimate business entities. This Policy shall be construed as a proactive measure toward compliance, ethical content curation, and responsible digital conduct in accordance with prevailing regulatory expectations.

SCOPE OF APPLICATION

This Policy shall be applicable to all natural or legal persons who, whether directly or indirectly, engage with, contribute to, or benefit from the publication, access, display, dissemination, or reliance upon any form of user-generated content (UGC) on or through the Proviews platform and its affiliated tools, plugins, or integrations. The scope shall extend to all forms of content posted by users, including but not limited to written reviews, star or numerical ratings, testimonials, opinions, product or service feedback, and any other narrative or evaluative expression, whether submitted voluntarily or upon solicitation, and irrespective of whether such content is verified or unverified. The Policy shall equally bind merchants, sellers, customers, employees, affiliates, influencers, and any third-party service providers associated with the platform.

STANDARDS OF AUTHENTICITY

All content submitted to Proviews must meet the minimum thresholds of verifiability, relevance, accuracy, and good faith. Content that fails to satisfy these standards shall be deemed non-compliant and subject to removal or other remedial measures.

1. Truthfulness and Accuracy: Users shall ensure that any content submitted by them is an honest and factual representation of their personal and first-hand experience with the relevant product, service, or merchant. Statements of opinion must be rooted in real interactions and may not contain exaggerations, mischaracterisations, or baseless assumptions. Content that is misleading by omission or inference shall be deemed violative of this Policy.

2. Prohibition on Fabrication: The submission or propagation of fabricated content whether created by automated systems, bots, fake accounts, or third parties with no actual experience is expressly prohibited. Users shall not publish or cause the publication of content that is fictitious, manufactured, or designed solely to manipulate perception, ratings, or reputation. Any attempt to generate bulk reviews, duplicate submissions, or otherwise simulate user consensus shall be treated as a grave violation.

3. Conflicts of Interests: All contributors must disclose any material connection they may have with the subject of their review, including employment, ownership, financial interest, familial relationship, or any other affiliation that may give rise to a potential or perceived conflict of interest. Undisclosed promotional content or self-serving endorsements masquerading as impartial user feedback shall be deemed inauthentic and subject to immediate removal, with appropriate sanctions levied upon the violator.

4. Incentivised Content: Content submitted in exchange for any form of consideration—be it monetary, discount-based, promotional, or in-kind—must be accompanied by an explicit disclosure of the nature and extent of such incentive. Any failure to provide such disclosure shall render the content misleading and non-compliant. Merchants soliciting incentivised reviews shall bear responsibility for ensuring that disclosures are properly made and shall remain accountable for the authenticity of the resultant content.

5. Identity and Attribution: Users shall not impersonate any other individual, entity, or organization when submitting content to the platform. All submissions must be attributable to a verifiable identity, and Proviews reserves the right to require proof of purchase, usage, or identity where suspicion of impersonation, misrepresentation, or fraudulent submission arises. Anonymous or pseudonymous content may be flagged or removed if its authenticity cannot be reasonably ascertained.
6. User Responsibility and Representation: By submitting content to the Proviews platform, users represent and warrant that such content: (a) is their original creation or submitted with full rights and permissions; (b) does not infringe any third-party rights including intellectual property or privacy; and (c) does not violate any law, regulation, or contractual obligation. Users shall indemnify and hold harmless the Company from any claims arising from such submission

VERIFICATION MECHANISM

Proviews may, in its sole and absolute discretion, implement and operate a multi-tiered verification mechanism to evaluate the authenticity of submitted content. Such mechanisms may include but are not limited to: 

1. correlation of reviews with actual transactional data, order histories, or account records; 
2. randomised or targeted content audits; 
3. algorithmic detection of anomalous patterns indicative of coordinated manipulation; and 
4. engagement of human moderators or third-party verification partners. Where verification is not feasible or completed, the content may be prominently marked as an “Unverified Review” and governed accordingly. Verified content shall be appropriately labelled and prioritised in the interest of transparency.

ENFORCEMENT AND REMEDIAL ACTION

To ensure compliance with this Policy and preserve the integrity of user-generated content on the platform, Proviews shall undertake proactive measures to monitor submissions. Upon receiving credible reports or independently detecting irregularities, the Company will initiate internal investigations. These investigations may involve a review of metadata, submission patterns, identity verification, and other relevant indicators. During this process, affected content may be temporarily withheld from publication or visibly marked as “Under Review” until the inquiry is concluded.

Where a breach of the Policy is confirmed, Proviews reserves the right to take appropriate remedial actions. Such actions may include, without limitation: (a) removal of content found to be non-compliant; (b) issuance of warnings to the user or merchant responsible; (c) temporary or permanent suspension of user accounts or merchant listings; (d) withdrawal of platform privileges; and (e) referral of repeat or serious violations to appropriate legal or regulatory bodies, including consumer protection authorities and cyber law enforcement agencies.

Any user or merchant who wishes to contest the removal of content or the imposition of any sanctions may do so through the grievance redressal mechanism established by Proviews. Appeals must be submitted in writing to support@simprosys.com, clearly setting out the grounds for challenge. The Company will make reasonable efforts to evaluate such appeals in good faith and communicate its decision within a reasonable timeframe.

RETENTION OF CONTENT

Proviews reserves the right to retain all submitted content, including removed or unpublished items, for a reasonable period as necessary to comply with applicable legal obligations, resolve disputes, enforce agreements, or conduct audits. Such archived content may not be publicly visible but may be retained in secure systems for regulatory or evidentiary purposes.

LIMITATION OF LIABILITY

While the Company undertakes reasonable and diligent efforts to foster a credible and user-driven feedback ecosystem, it does not warrant or guarantee the absolute accuracy, veracity, or completeness of every item of content published on the platform. Users are advised to exercise personal discretion in interpreting and acting upon such content. Except to the extent mandated under applicable law, the Company shall not be liable for any direct, indirect, incidental, or consequential loss or damage arising from reliance on any user-generated content or the consequences of its publication, non-publication, or removal.

AMENDMENT

Proviews reserves the unequivocal right to amend, revise, or replace this Policy in whole or in part, at any time, in response to evolving legal requirements, technological enhancements, or business exigencies. Any such modification shall be effective upon its publication on the platform and users shall be deemed to have accepted the revised Policy upon continued usage of the Services thereafter. Users are encouraged to periodically review this Policy to remain apprised of their rights and responsibilities.

CROSS-BORDER DATA FLOW

In the course of collecting, verifying, moderating, and publishing user-generated content, including but not limited to reviews, testimonials, ratings, and feedback, Proviews may transfer, store, or process certain personal data or metadata outside the User’s country of residence, including on servers or through service providers located in jurisdictions such as India or other foreign territories.

By accessing or using the Platform and submitting content thereto, you acknowledge and consent to such cross-border transfers, which may be necessary for the provision of services, performance of verification procedures, technical operations, or customer support. The Company undertakes to ensure that any such transfer is conducted in accordance with applicable data protection laws and is subject to reasonable safeguards intended to maintain the confidentiality, integrity, and security of the personal data.

To the extent required by applicable laws, the Company shall implement appropriate contractual, technical, and organizational measures to ensure that the rights and interests of users are protected in connection with any such international data transfers. Users accessing the Platform from foreign jurisdictions are solely responsible for ensuring compliance with any local legal requirements that may be triggered by such use, including in relation to cross-border data disclosures.

LOCAL LAWS

The Company controls and operates this Platform from its headquarters in Ahmedabad (Gujarat), India and makes no representation that the Services offered on the Platform are appropriate or available for use in other locations or jurisdictions. If you use this Platform from other locations/jurisdiction, you are responsible for compliance with applicable local laws (including the taxation aspect, Fiscal and Economic Laws) and regulations including but not limited to the export and import regulations of other countries. Unless otherwise explicitly stated, all marketing or promotional materials found on this Platform are solely directed to individuals, companies or other entities interested to getting on boarded onto platform for the services as may be enlisted therein from time to time. By agreeing to these terms and conditions of use, you confirm and undertake that neither you nor any of your representatives shall have the right to challenge the governing law and jurisdiction as more specifically set out herein.
