Review Fraud Policy
This Review Fraud Policy (hereinafter referred to as the “Policy”) is formulated and enforced by Simprosys Infomedia, the operator of the Proviews platform (“Platform”), having its registered office at: B-303, Shapath Hexa, Opp. Gujarat High Court, S.G. Highway, Ahmedabad, Gujarat – 380060 India. This Policy sets forth the terms, conditions, and standards relating to the collection, submission, display, and management of reviews on the Platform to ensure the authenticity, integrity, and trustworthiness of all feedback. By accessing, using, or interacting with the Platform in any manner, you (“User,” “You,” or “Your”) expressly acknowledge, accept, and agree to be legally bound by the terms of this Policy, which shall form an integral part of the Platform’s Terms and Conditions.
Before you use the platform, you must read all of the terms and conditions of this policy (“Terms”) herein provided on the Website. Please also refer to the additional legal information as may be applicable to you. You must be at least 18 years of age to use our platform/website; by using our platform and agreeing to the contents of this policy, you warrant and represent to us that you are at least 18 years of age. Audience less than 18 years of age should register with credentials of Parent(s) and/or Legal Guardian. The platform shall not be responsible for validating and authenticating your age, however, the platform reserves the right to optionally / randomly conduct checks to verify the correctness of legal age of your’ s / your legal guardian’s age registering on platform on your behalf.
“we”, “our” and “us” means “the Company”; “you”, “user” and “your” means any person and/or the institutions / organizations etc., but not limited to, who accesses and uses this Platform along with updating their users on this platform.
It is strongly recommended to you to visit this page periodically to review the most recent and current version of this policy. The Company reserves the right at any point of time, at its sole discretion, to change or otherwise modify the terms of this policy without prior notification or notice to you, and your continued access or use of this platform signifies your acceptance of the updated or modified terms. If you object to this policy or any subsequent modifications to this policy or become dissatisfied with the platform in any way, you should immediately terminate the use of this platform. Should parts of this information not or no longer comply with applicable law, the remaining parts of the information remain unaffected in terms of its content and validity.
DEFINITIONS
For the purposes of this Policy, the following terms shall have the meanings ascribed to them below unless the context otherwise requires:
- “Review” means any written, visual, or audio content, rating, feedback, testimonial, or other form of evaluation posted by Users on the Platform relating to products, services, merchants, or the Platform itself.
- “Review Fraud” means any act or omission that involves the submission, solicitation, or manipulation of reviews that are false, misleading, fabricated, incentivized without disclosure, or otherwise designed to misrepresent the genuine experience or quality of the subject matter of the review.
- “User” means any individual, entity, merchant, third-party service provider, or other party who accesses or uses the Platform or submits reviews thereto.
PURPOSE AND APPLICATION
This Policy is intended to maintain and promote a fair, transparent, and reliable review environment on the Platform, safeguarding the interests of all Users and ensuring compliance with applicable laws and industry standards. This Policy applies to all Users who post, solicit, manage, or interact with Reviews on or through the Platform, regardless of the mode or origin of such Reviews.
PROHIBITED REVIEW CONDUCT
Users shall strictly refrain from engaging in any acts constituting Review Fraud, including but not limited to:
- Submitting or facilitating the submission of Reviews that are knowingly false, misleading, fabricated, or lacking any bona fide experience with the product or service reviewed.
- Offering, providing, or accepting any form of compensation, incentive, or benefit in exchange for Reviews, except where such incentives are explicitly permitted, fully disclosed, and compliant with applicable legal requirements.
- Utilizing multiple identities, accounts, or personas to post duplicate, conflicting, or misleading Reviews for the same subject matter.
- Altering, removing, suppressing, or otherwise manipulating Reviews to distort genuine consumer opinion or product representation.
- Posting content within Reviews that is unlawful, defamatory, obscene, harassing, discriminatory, promotional, or in violation of any applicable laws or Platform standards.
- Submitting Reviews by parties having a conflict of interest, including but not limited to employees, affiliates, family members, or competitors of the merchant or product subject to the Review.
REVIEW COLLECTION, VERIFICATION, AND MONITORING
The Company endeavors to ensure that all Reviews collected through the Platform are genuine and represent the honest opinions of verified purchasers or users. Reviews solicited via automated, permission-based communications sent to verified customers shall be considered verified Reviews. Reviews imported from external sources shall be accepted without modification but are subject to the same standards and scrutiny as original Reviews.
The Company reserves the absolute right to monitor, verify, and investigate the authenticity of all Reviews through automated means, manual inspections, or other methods it deems appropriate. Reviews found to be non-compliant with this Policy may be removed, flagged, or withheld from display without prior notice.
ENFORCEMENT AND REMEDIAL MEASURES
To protect the integrity of the Platform and its Users, the Company reserves the right to take any and all necessary actions in response to violations of this Policy, including but not limited to:
- Removing, disabling, or otherwise restricting access to fraudulent or non-compliant Reviews.
- Suspending, restricting, or terminating the accounts of Users or merchants engaged in Review Fraud or related misconduct.
- Reporting illegal or egregious activities to appropriate regulatory, law enforcement, or governmental authorities.
- Exercising all other rights and remedies available under applicable law, including claims for damages, injunctions, or other equitable relief.
USER REPORTING OBLIGATIONS
Users are encouraged to report any suspected instances of Review Fraud or violations of this Policy promptly by contacting the Company at support@proviews.com. The Company commits to treating all reports with confidentiality and investigating them thoroughly.
COMPLIANCE WITH LAWS AND REGULATIONS
The Company adheres strictly to all applicable laws, regulations, and guidelines related to online reviews, advertising, and consumer protection. This includes compliance with the Federal Trade Commission (FTC) guidelines on endorsements and testimonials, the Consumer Protection Act of India, and any other jurisdictional mandates relevant to the Platform’s operations.
AMENDMENTS TO THE POLICY
The Company reserves the right, at its sole discretion, to modify, amend, or update this Policy at any time without prior notice. Continued use of the Platform following any changes shall constitute acceptance of the updated Policy. Users are advised to review this Policy periodically to remain informed of its current terms.
INDEMNITY
You hereby agree to indemnify, defend, and hold harmless the Company, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of this Policy, including but not limited to submission or solicitation of fraudulent reviews.
GOVERNING LAW AND JURISDICTION
The Company controls and operates this Platform from its headquarters in Ahmedabad (Gujarat), India and makes no representation that the Services offered on the Platform are appropriate or available for use in other locations or jurisdictions. If you use this Platform from other locations/jurisdiction, you are responsible for compliance with applicable local laws (including the taxation aspect, Fiscal and Economic Laws) and regulations including but not limited to the export and import regulations of other countries. Unless otherwise explicitly stated, all marketing or promotional materials found on this Platform are solely directed to individuals, companies or other entities interested to getting on boarded onto platform for the services as may be enlisted therein from time to time. By agreeing to these terms and conditions of use, you confirm and undertake that neither you nor any of your representatives shall have the right to challenge the governing law and jurisdiction as more specifically set out herein.
CROSS-BORDER DATA FLOW
In connection with the submission, display, and moderation of Reviews on the Platform, the Company may collect, store, and process certain personal data of Users. Such data may be transferred to, stored in, or accessed by the Company’s affiliates, service providers, or partners located in jurisdictions outside the User’s country of residence, including but not limited to India.
Where required under applicable laws, the Company shall ensure that any cross-border transfer of personal data is conducted in accordance with lawful and appropriate mechanisms that ensure an adequate level of protection for such data. By using the Platform and submitting Reviews or associated information, you consent to the transfer, storage, and processing of your data across borders, including to locations where data protection standards may differ from those in your jurisdiction.
The Company commits to maintaining reasonable technical and organizational safeguards to protect your personal data, regardless of the country in which it is processed. If you are subject to local laws that require additional consents or impose specific restrictions on international data transfers, it is your responsibility to ensure compliance before using the Platform.
DISPUTE RESOLUTION
In the event of any dispute, controversy, or claim arising out of or relating to this Policy, the Parties shall first attempt to resolve the matter amicably through good faith negotiations within thirty (30) days. Failing such resolution, the dispute shall be finally settled by arbitration administered in accordance with the Arbitration and Conciliation Act, 1996 (as amended), conducted by a sole arbitrator appointed by mutual consent of the Parties. The arbitration proceedings shall be held in Ahmedabad, India, in the English language, and the arbitral award shall be final, binding, and enforceable in any court of competent jurisdiction.
