Copyright Policy
Welcome to Proviews Product Reviews & QA (“the App”, “we”, “our”, “us”), a Shopify application available on the Shopify platform. The App is owned and operated by Simprosys Infomedia (“the Company”).
The owner and operator of the Service – Proviews (“the App”, “we”, “our”, “us”) – respects the intellectual property rights of others and requests that its users do the same.
1. Alleged Infringement Notice
If you believe that your copyrighted work has been infringed upon through the Service, you may submit an infringement notice via email to support@simprosys.com. Your notice should include the following information:
- Signature: A physical or electronic signature of the person authorized to act on behalf of the owner of the allegedly infringed copyright.
- Identification of the copyrighted work: A description of the copyrighted work claimed to have been infringed, or if multiple copyrighted works are involved, a representative list of such works.
- Identification of the infringing content: A description of the content that is alleged to be infringing or the subject of the infringing activity, along with sufficient details to help us locate the content (such as the specific page on the Service where the content was found).
- Contact information: Information sufficient for us to contact you, such as your address, telephone number, and, if available, an email address.
- Good faith statement: A statement that you have a good faith belief that the use of the content, as described, is not authorized by the copyright owner, its agent, or the law.
- Accuracy statement: A statement that the information provided in the notice is accurate and that under penalty of perjury, you are authorized to act on behalf of the copyright owner.
Upon receiving your notification, we may remove or disable access to the content that you claim is infringing. We may request further or supplementary information before taking action to ensure compliance with applicable laws. In some cases, we may provide the user who posted the allegedly infringing content with your contact details so they can contact you directly to dispute your claim.
2. Counter-Notification
If we have removed or disabled access to your content following an infringement notice, you have the right to submit a counter-notification. Your counter-notification must be in writing and include the following:
- Signature: Your physical or electronic signature.
- Identification of the removed content: A description of the content that was removed or to which access was disabled, and the location of the content before its removal or disabling.
- Good faith belief statement: A statement, under penalty of perjury, that you have a good faith belief that the content was removed or disabled due to a mistake or misidentification.
- Your contact details: Your name, address, telephone number, and a statement consenting to the jurisdiction of the competent courts in your judicial district, or where you can be found. You must also agree to accept service of process from the person who filed the infringement notice or their agent.
Once we receive your counter-notification, we will send a copy of it to the person who submitted the original infringement notice.
Subject to applicable law, we may replace the removed content and restore access within 15 to 30 business days following receipt of the counter-notification, unless we are notified by the original complainant that they have filed a lawsuit seeking a court order to prevent the infringing activity.
3. Repeat Infringements
If we determine, at our sole discretion, that you are a repeat infringer, we may terminate your user account on the Service. A repeat infringer is a user who has received multiple notifications of infringing activity or whose content has been removed from the Service more than twice due to claims of infringement.
4. Misrepresentations
Any person who knowingly misrepresents that content is infringing or that content was removed or disabled due to mistake or misidentification may be liable for any damages, including costs and attorney’s fees, incurred as a result of such misrepresentation. This includes damages suffered by us as a result of relying on the misrepresentation to remove or disable access to content.
