    Data Processing Agreement

    Introduction:

    This agreement sets forth the terms and conditions for the protection and use of customer data obtained through (the app) “Simprosys Customer Match Lists” for the customer match list. The purpose of this agreement is to ensure the privacy and security of customer data and to provide transparency about how the data will be collected, used, and protected.


    Customer Data:

    The term "Customer Data" refers to any personal or non-personal information collected from your store’s customers, including but not limited to email addresses.


    Data Collection:

    The app will only collect & store Customer Data for the purpose of syncing it to Google Ads for targeted advertising purposes, and will not use the data for any other purpose.


    Data Security:

    The app implements reasonable and appropriate security measures to protect the confidentiality and security of Customer Data, including secure storage. The app will maintain the confidentiality and security of Customer Data and will take all reasonable steps to protect against unauthorized access, use, or disclosure of Customer Data. Data Processed via Google's API Our App places a high value on your privacy and treats your data with the utmost care and responsibility. Any data we obtain through Google APIs is used by our app or shared with other applications in strict adherence to the Google API Services User Data Policy. This includes strict compliance with the policy's Limited Use requirements.


    Data Access:

    The app will not share, sell, or otherwise disclose Customer Data to any third party, except as required by law or as necessary to perform the services outlined in this agreement.


    Data Retention:

    The app will retain Customer Data only for as long as necessary to fulfill the purpose for which it was collected, and will securely delete the data when it is no longer needed or within 60 days after the uninstallation of the app from your store.


    Merchant Responsibility:

    Merchant is responsible for obtaining proper consent from their customers for the collection, use, and disclosure of their Customer Data by the app, and for ensuring that the collection, use, and disclosure of Customer Data is in compliance with all applicable laws and regulations. The Merchant will be solely responsible for any claims or legal action arising from its failure to obtain proper consent or its failure to comply with applicable laws and regulations.


    Changes to the Agreement:

    This agreement may be updated from time to time to reflect changes in applicable laws and regulations or changes in the Simprosys Customer Match Lists' practices. The updated agreement will be posted on the Simprosys Customer Match Lists website.


    Governing Law:

    This agreement will be governed by and construed in accordance with the laws of the local jurisdiction in which the app is registered. Any dispute arising from this agreement will be resolved through binding arbitration in accordance with the rules of the arbitration organization selected by the parties.
