Privacy Policy – ParcelDesk by Simprosys

Simprosys (“Company”, “we”, “us”, “our”) respects your privacy and is committed to protecting your Personal Data (as defined below) in accordance with applicable data protection and privacy laws, including the General Data Protection Regulation (“GDPR”), the California Consumer Privacy Act (“CCPA”) and other applicable data protection laws (collectively, “Data Protection Laws”).

Thank you for choosing ParcelDesk, a service provided by Simprosys. This privacy policy outlines how we collect, use, disclose, and protect your information when you use our ParcelDesk application and website (collectively referred to as the “Service”). By accessing or using the Service, you agree to this privacy policy. 

This policy applies to our App only. It does not apply to any other third-party website, application, or service that you may access through our App, which may have its own privacy policy.

1. INFORMATION WE COLLECT:
We collect information you provide directly to us when you use the Service. This may include:

1.1 Tracking Information: 
To provide shipment tracking, we fetch orders from your store and data related to them, such as tracking numbers, package details, customer name, phone number, delivery address and delivery status.

1.2 Personal Information: 
We collect information, such as your store name, email address, or phone number, to help you with shipment status or to send tracking updates if you subscribe to our notifications.

1.3 Usage Information: 
Information about how you use the Service, including log data, device information, and location information if you enable location services.

1.4 Integration Information: 
If you choose to integrate ParcelDesk with Facebook Messenger, Instagram, or WhatsApp to provide customer support, we collect recipient_id, name, profile picture, and phone number information of the respective customer account.

2. HOW WE USE YOUR INFORMATION

When you install the App, we are automatically able to access certain types of information from your e-commerce store. The app does not share your information without your specific action or explicit request. Below is the list of permissions we take about your store.

2.1 Store Information
We are collecting basic information from a store like Store Name, Store Domain, Address, Contact Email, Support Email, Phone No, Store Plan, etc. This information shall be used to:

• Create an account on our App.
• Send a notification email to the store owner whenever there is a process completion or some error in the Shipment Tracking process.
• We may use your information to respond to inquiries, provide assistance, or resolve any issues related to shipments.
• We may share your information with third-party service providers who assist us in delivering shipment tracking services.
• We use this personally identifiable information of store owners to have effective communication related to different processes on our app.
• We never send any promotional emails related to cross-selling of our services or launching any other service that is not in the scope of the app. 
• We do send emails related to updates launched, bug fixes, updates in the documentation, and any other change that may affect the utility of this app.
• Comply with legal obligations.

2.2 Write Page
This permission is taken to insert the “Track My Order“ page into the merchant’s online store theme.

2.3 Read Orders
To ensure smooth Shipment Tracking the app needs to read orders received on the store so we request permission for the same at the time of installation and this allows us to get customer names, e-mail addresses, phone numbers, order fulfilment data such as tracking numbers, order status, product details, and other relevant order-related data.

2.4 Data Retention
We will only retain your Personal Data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

To determine the appropriate retention period for Personal Data, we consider the amount, nature, and sensitivity of the Personal Data, the potential risk of harm from unauthorized use or disclosure of your Personal Data, the purposes for which we process your Personal Data, and whether we can achieve those purposes through other means, and the applicable legal requirements.

When you choose to uninstall the app, we keep your data saved for 30 days in case you reinstall the app you can have your order data as it is. Past these 30 days, all your data will be automatically deleted from the database.

Merchants can connect with the support team if they wish to download the order data before uninstalling the app or within this 30 days period.

3. CCPA PRIVACY POLICY (DO NOT SELL MY PERSONAL INFORMATION)

The California Consumer Privacy Act (“CCPA”) provides California residents with certain rights regarding their Personal Information. If you are a California resident, you have the right to:

• Know what personal information we collect about you and the purposes for which we use it;
• Request deletion of your personal information;
• Opt-out of the sale of your personal information, if applicable;
• Access your personal information; and
• Non-discrimination for exercising your rights under the CCPA.

Please note that we may require additional information from you in order to verify your identity before processing your request.  If you make a request, in some cases it can take us upto 7 working days to respond to you.

4. GDPR PRIVACY POLICY (DATA PROTECTION RIGHTS)

If you are located in the European Union, you have certain rights under the General Data Protection Regulation (“GDPR”). These include the right to:
• Be informed about the processing of your Personal Data;
• Access your personal data;
• Rectify inaccurate or incomplete personal data;
• Erase your personal data;
• Restrict the processing of your personal data;
• Object to the processing of your personal data; and
• Data portability of your personal data.

5. DATA PROCESSED VIA GOOGLE’S API 

Our App places a high value on your privacy and treats your data with the utmost care and responsibility. Any data we obtain through Google APIs is used by our app or shared with other applications in strict adherence to the Google API Services User Data Policy. This includes strict compliance with the policy’s limited use requirements.

6. CHILDREN’S INFORMATION

Another part of our priority is adding protection for children while using the internet. We encourage parents and guardians to observe, participate in, and/or monitor and guide their online activity.
Simprosys does not knowingly collect any Personal Identifiable Information from children under the age of 16. If you think that your child provided this kind of information on our website, we strongly encourage you to contact us immediately and we will do our best efforts to promptly remove such information from our records. We take special precautions and care for children and take the best possible measures to protect them. However, even after taking all the necessary precautions, we cannot completely restrict their access.  Hence, it is the responsibility of parents to supervise their child’s activity on electronic devices and take necessary steps like child lock etc. to make sure that they do not use our services. 

7. DISCLOSURE PRACTICES

We disclose personal information if we are required by law or by a court order, in response to a law enforcement agency, to the extent permitted under other provisions of law, to provide information, or for an investigation on a matter related to public safety.
If our website or organisation is taken over, sold, or involved in a merger or acquisition, your details may be disclosed to our advisers and any prospective purchasers and will be passed on to the new owners.

8. LIMITATION OF LIABILITY

In no event shall Simprosys or ParcelDesk be liable for any indirect and consequential damages, even if we knew or should have known of the possibility thereof. These limitations shall apply to the fullest extent permitted by law. In some jurisdictions, some of the foregoing limitations may not apply.

9. DATA SECURITY

We take reasonable measures to protect your information from unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

10. CHANGES TO THIS PRIVACY POLICY

Simprosys or ParcelDesk shall regularly review the sufficiency of this privacy policy. We reserve the right to modify and change the privacy policy at any time. Any changes to this policy will be published on the platform.

Continued use of our App by You implies acceptance of the revised policy. This policy is an integral part of Simprosys Terms and Conditions.
